A real estate agent is required to have a license in order to receive commission for products or services they sold or rendered as real estate broker. Unlicensed person will consider all his activities illegal. But lawyers that would act as real estate broker do not require any license to do the transaction. Today, in many estates, brokers and their agents required to take a licensing exam after a minimum number of classes taken before they can be consider as broker or agents. Agreements are being signed under the agency- seller and buyer relation, thus creating a law with fiduciary obligations. But there are non-agency relationships as well wherein there is no written real estate transaction nor fiduciary relationship exists. This agency did not entered into a Buyer Agency agreement with the broker buys the property and functions as sub-agent. It says that if a seller chooses to work with transaction broker, there is no relationship exists.

There are many types of agencies and agents exist today. We just need to choose between their good services and offer. And in anyways, considering yourself as an agent is not prohibited. You can do transactions like buying and selling, you’ll just have to be knowledgeable of the legalities.
